S253 of the Criminal Code

Every one commits an offence who operates a motor vehicle or vessel or operates or assists in the operation of an aircraft or of railway equipment or has the care or control of a motor vehicle, vessel, aircraft or railway equipment, whether it is in motion or not,
(a) while the person's ability to operate the vehicle, vessel, aircraft or railway equipment is impaired by alcohol or a drug; or
(b) having consumed alcohol in such a quantity that the concentration in the person's blood exceeds eighty milligrams of alcohol in one hundred millilitres of blood.

The Penalty in Ontario-1st Offence

  • Driver’s Licensre Suspension for 1 year
  • A fine of not less than $600
  • Installation, at your cost, of an Ignition Interlock system in your car for 1 year

The Penalty in Ontario-2nd Offence

  • Driver’s Licence Suspension for 3 years
  • Mandatory Jail Term
  • Installation, at your cost, of an Ignition Interlock system in your car for 3 years
  • Participation in the Back on Track Course for 11 months

The Personal Penalty of Impaired Driving-DUI Conviction in Ontario

  • A Permanent Criminal Record
  • Job Lost or the denial of Future Employment
  • The denial of entry into certain countries
  • High Risk Driver label (you may have to pay facility rated insurance rate
