The Offence of Racing began being enforced in October of 2007. In the Province of Ontario, Racing has been defined as one or more cars traveling at an illegal rate of speed that might suggest that the vehicle is involved in a competition.

However, driving at an excessive speed, is not the only act that may land you this charge. Repeatedly changing lanes in the close range of other vehicles can cause you to be charged with the offence of Racing.

Stunt Driving

Actions that are considered to be Stunt Driving in Ontario

• Driving at a rate of speed that is higher than 50km/hr
• Driving without care and attention to the road or without reasonable care for the safety of others on the road

For example:

• Preventing another car from passing without reason
• Stopping or slowing your car in a manner that interferes with the movement of the cars behind you.
• Completing Donuts (circular motions with your car)
• Driving your car in a position that is not seated in the driver’s seat
• Driving with passengers in your trunk
• Improper turns

 

The Law in Ontario

HTA 172(1) No person shall drive a motor vehicle on a highway in a race or on a bet or wager.

 

The Fine and Penalty in Ontario

A fine between $2000 to $10,000 dollars Imprisonment for a term of 6 months License Suspension for 7 days Vehicle Impoundment for 7 days
