The Rules of Restraint

All those seated in positions provided with seat belts, must use the complete seat belt assembly provided (ie. lap and shoulder belt, or lap belt only). The belt must also be worn properly, adjusted, and securely fastened. If five people travel in a four seater vehicle, one person can legally travel unrestrained.

Children under 23kg (50lbs) can have shoulder belts tucked behind them and just wear lap belts. This is to prevent the shoulder belt from cutting across their necks.

Toddlers, that is children between 9-18kg (20-40lbs) must be in a child safety seat in their parents of legal guardian's vehicle. In another person's vehicle they can use a lap belt. At this age a child is safer in a in child safety seat, however, it is not always possible to install the seat in another vehicle.

Infants between birth and 9kg (20lbs) cannot sit up alone, so there is no safe alternative to a child safety seat; therefore, they must always travel in a rear-facing child safety seat.

The driver is responsible to ensure all passengers under 16 years of age are properly restrained. If a child is under 23kg (50lbs) he/she must occupy a seat fitted with a seat belt when available.

The fine for not wearing an appropriate restraint system, or not wearing it correctly, is $60-$500.

All child safety seats must meet the Canada Motor Vehicle Safety Standard 213, and must be used in accordance to the manufacturer's instructions.

If a school bus has been equipped with seat belts for each passenger they must be worn; however, due to the structure of the vehicle and the compartmentalization of the seats, excellent passive protection is offered in post-1981 school busses without the use of seatbelts. Experimental busses , with lap belts and rear facing seats, have been tested by Transport Canada.

Seat belt standard for new vehicles are under the jurisdiction of Transport Canada. No one may remove, render inoperative or modify a set belt to reduce its effectiveness and they must be maintained in good working order.
