Demerit Points for Out-of-Province Violations
Drivers receiving a traffic ticket in the State of New York, the State of Michigan or any Canadian province or territory, will have home jurisdictional penalties such as demerit points applied to their Ontario driver record as if the offence occurred in Ontario.
When faced with a traffic ticket it is wise to familiarize yourself with the options which are available at your disposal. The first option, which many motorists chose as a result of simplicity, is admitting to your guilt, paying off the fine and having demerit points added to your record. This option proves to be the most risky. Not only does your record have a conviction but your insurance rates can go up depending on the nature of the ticket! Collect more than one zero point ticket and your insurance rates will go up. Thus, the third option, the trial option is the best option if you want to have your ticket completely eliminated! Although it is your right to represent yourself in court, unless you have studied traffic law and are familiar with all its technicalities, it is not recommended that you go into trial by yourself. There seems to be many misconceptions about how easy it is to get your ticket dismissed in court, however please think twice before actually representing yourself!
First of all, as you take the stand and are sworn in, you are expected to testify truthfully to the best of your knowledge. The reason why you should not defend yourself is simple: you do not want to lie under oath and perjure yourself. Unless you really didn’t commit the offence you were charged with and you strongly believe that you have been wrongfully accused, you should not testify. If you defend yourself, you will either have to say you really did commit this offence or you didn’t. Judges have no tolerance for excuses and ignorance of the law is not a valid excuse! Unless you have special recollection of other facts to support your claim, nobody will believe you and remember the police officer’s credibility is always higher than yours.
Another common misconception is that a case can be won easily as a result of the police officer not showing up for the trial. Police officers’ absence from trial usually gets blown out of proportion.
Presently, courts book trial dates around the police officer’s schedule. This means that the police officer only has to show up for one full day and all of his cases are presented one after the other. Plus they do get paid overtime for attending court, so why would not they show up? Thus, don’t go into court expecting that the cop will be absent. Many people make this critical error and they do not prepare themselves for the case and as a result lose their case.
